General Terms and Conditions Plaisier Platform Challenge & Valentijn Plaisier<\/h4>

\u00a0<\/p>

Article 1 – Definitions<\/h4>

In these terms and conditions, the following definitions apply:<\/p>

  1. The Company \/ Entrepreneur:<\/b> Plaisier Platform Challenge \/ Valentijn Plaisier (service provider and seller).<\/p><\/li>

  2. Client:<\/b> The business counterparty entering into a contract for services (e.g., for training sessions or events).<\/p><\/li>

  3. Customer \/ Consumer:<\/b> The natural person not acting in the course of a profession or business who enters into a distance contract (e.g., for purchasing books or e-books via the website).<\/p><\/li>

  4. Products:<\/b> Physical and digital goods, including books, e-books, and related merchandise.<\/p><\/li>

  5. Services \/ Assignment:<\/b> The provision of (in-house) projects, events, lectures, and training.<\/p><\/li><\/ol>

    Article 3 – Applicability<\/h4>

    1. These terms and conditions apply to all offers, quotations, and webshop orders from Plaisier Platform Challenge, as well as to all agreements regarding the delivery of Products and the provision of Services.<\/p><\/li>

    2. Before the distance contract (webshop order) is concluded, the text of these general terms and conditions will be made available to the Customer.<\/p><\/li><\/ol>

      \u00a0<\/p>

      Article 4 \u2013 Conclusion of the Agreement<\/h4>

      1. All offers and quotations are without obligation.<\/p><\/li>

      2. An agreement for Services (such as events) is concluded upon written or digital approval of the quotation by the Client.<\/p><\/li>

      3. An agreement for Products (such as books) is concluded at the moment the Customer places an order via the website and fulfills the stipulated conditions (such as payment).<\/p><\/li><\/ol>

        \u00a0<\/h4>

        Article 5 \u2013 Right of Withdrawal and Delivery (Webshop \/ Books)<\/h4>

        1. When purchasing physical Products, the Consumer has the right to dissolve the contract without giving any reason within 14 days (right of withdrawal). This cooling-off period starts on the day after the product is received.<\/p><\/li>

        2. During the cooling-off period, the Consumer will handle the book and packaging with care. Return shipping costs are borne by the Consumer.<\/p><\/li>

        3. Exception for digital products:<\/b> The right of withdrawal does not apply to the purchase of digital content (such as e-books), provided the Consumer has explicitly agreed to immediate delivery and thereby waived their right of withdrawal.<\/p><\/li>

        4. Plaisier Platform Challenge aims to dispatch ordered Products within the delivery timeframe stated on the website. No strict legal rights can be derived from these estimated times.<\/p><\/li><\/ol>

          \u00a0<\/p>

          Article 6 – Cancellation or Modification of Events by the Client (Standard Location)<\/h4>

          1. The Client has the right to cancel the Assignment (event\/training) by email or in writing. Cancellation or modification can be made free of charge up to 14 days before the start of the Assignment.<\/p><\/li>

          2. In the event of cancellation or modification less than 14 days before the start, the Client must reimburse 50% of the quotation amount. Costs are calculated from the moment the Assignment was scheduled to begin.<\/p><\/li><\/ol>

            \u00a0<\/p>

            Article 7 – Cancellation or Modification of Events by the Client (Bataviawerf Location in Lelystad)<\/h4>

            1. For assignments at the Bataviawerf location, cancellation or modification can be made free of charge up to 30 days before the start.<\/p><\/li>

            2. In the event of cancellation or modification up to 20 days before the start, the Client must reimburse 50% of the quotation amount.<\/p><\/li>

            3. In the event of cancellation or modification less than 14 days before the start, the Client must reimburse 100% of the quotation amount.<\/p><\/li><\/ol>

              \u00a0<\/p>

              Article 8 – Cancellation or Modification by Plaisier Platform Challenge & Replacement<\/h4>

              1. Plaisier Platform Challenge reserves the right to cancel or modify the Assignment without stating reasons (e.g., due to insufficient participants or force majeure). If possible, a suitable alternative will be offered.<\/p><\/li>

              2. In the event of cancellation by the Company, no costs will be charged to the Client, and a full refund of any monies already paid for the relevant Assignment will be issued.<\/p><\/li>

              3. Plaisier Platform Challenge reserves the right to replace a trainer, speaker, or facilitator with another qualified professional.<\/p><\/li><\/ol>

                \u00a0<\/p>

                Article 9 – Pricing<\/h4>

                1. For Consumers (webshop), all stated prices are inclusive of VAT and exclusive of shipping costs.<\/p><\/li>

                2. For business Clients (quotations\/events), the stated prices are exclusive of VAT, unless stated otherwise.<\/p><\/li>

                3. All prices are subject to printing and typographical errors. The Company is not obliged to deliver a product or service at an incorrect price resulting from obvious errors.<\/p><\/li><\/ol>

                  \u00a0<\/p>

                  Article 10 – Payment<\/h4>

                  1. Webshop orders must be paid immediately upon placing the order using the provided payment methods.<\/p><\/li>

                  2. For Services (invoices), a payment term of 14 days after the invoice date applies, without suspension or set-off.<\/p><\/li>

                  3. In the event of late payment by a business Client, statutory commercial interest and reasonable extrajudicial collection costs will be charged following a written demand for payment.<\/p><\/li><\/ol>

                    \u00a0<\/p>

                    Article 11 \u2013 Intellectual Property & Copyright<\/h4>

                    1. The intellectual property and copyright of all works created by the Company\u2014expressly including books, stories, characters, concepts, project materials, and texts\u2014are vested exclusively in Valentijn Plaisier \/ Plaisier Platform Challenge.<\/p><\/li>

                    2. Without explicit written permission, these works, storylines, or materials may not be copied, published, reproduced, or used for other (commercial) purposes in any manner whatsoever.<\/p><\/li><\/ol>

                      \u00a0<\/p>

                      Article 12 \u2013 Liability<\/h4>

                      1. For delivered physical Products, liability is limited to the purchase amount of the respective product.<\/p><\/li>

                      2. For Services, Plaisier Platform Challenge is never liable for indirect damage (including consequential damage or lost profits). Liability is limited to the amount paid out by the liability insurance in the relevant case.<\/p><\/li>

                      3. The Company is not liable for damages resulting from incorrect or incomplete information provided by the Client or Customer.<\/p><\/li><\/ol>

                        \u00a0<\/p>

                        Article 13 – Complaints Procedure<\/h4>

                        1. Complaints regarding delivered Products or Services must be submitted by email, fully and clearly described, within 7 days of discovery.<\/p><\/li>

                        2. Complaints will be answered substantively within 14 days at the latest.<\/p><\/li><\/ol>

                          \u00a0<\/p>

                          Article 14 \u2013 Applicable Law<\/h4>
